Privacy Policy

Our law firm collects personal information only when you submit it to us. If you decide to submit such personal information, we or an external service provider will retain the information that you submit in a database, and we will use this information to complete your request. Any service provider that we designate will have agreed not to sell or distribute your information to any third party, and we will also not share the information with any third party except for the service provider. We may also use the information retained in the database to communicate with you directly via email or direct mail, such as to inform you about upcoming seminars that may be of interest to you.

In order to guard your nonpublic personal information, we maintain physical, electronic and procedural safeguards regarding site users' personal information, consistent with the accepted industry standards. However, your personal information will never be intentionally disclosed in a manner inconsistent with this policy but no guarantees can be made regarding intentional breaches of our security measures or criminal actions of others outside our control.

Currently, we only employ a “cookie” for more accurate anonymous traffic analysis such as tracking the time/date of the visit, the page viewed and the referring website. This cookie does not include personal information. The data that we do collect is never stored in any individual profile and only serves to update aggregate counts allowing us to monitor site traffic. We may share non-personal, anonymous information collected through cookies with third parties. Most browsers are initially set up to accept cookies. If you would prefer, you can set your browser to reject cookies.

Any changes to this privacy policy will be made through a revised posting on our website.

TERMS OF SERVICE

By clicking the “Accept” button below, you agree that you have read and understand these Terms of Service. By accepting these Terms of Service and requesting assistance and/or information from Blanchard Legal Solutions, PC, you are offering to create a binding legal contract which will become fully enforceable either when an attorney here undertakes to answer your specific personal question, or when you access the Answer Archives at this website.

You understand and agree that by seeking services or information of any sort from this website, you are for all purposes considered to be taking actions purposefully directed towards and within the State of Utah.

The information contained in the Answer Archives of this site will not be considered legal advice given to you, for reasons including but not limited to no dialogue taking place between you and a licensed attorney to uncover facts of your particular situation which may affect the answer to your question(s), or your desire to predict the likely outcomes to any particular situation or situations in which you may have an interest. Further, you understand and agree that the quality of any answers to individual questions which you may receive depends on the accuracy of the information which accompanies your question. Failing to be fully candid in your description of events, trying to minimize or “sugar coat” anything which you or anyone else in this situation may have said, written, or done, will almost always result in you receiving an answer to your question which is not accurate or fully applicable to the facts of your specific situation.

You further agree that by posting a question seeking a personalized answer, you are seeking limited scope legal services (also called “unbundled” legal services) relating only to your information request, and any and all answers posted here do not create any obligation on the part of any attorney answering your question to represent you in any case, legal dispute, or legal transaction.

By agreeing to these Terms of Service, you agree that for all purposes, you seek services in the State of Utah with the understanding and agreement that all of your rights, obligations, and duties, and remedies under the contract which will be created shall be governed by the laws of the state of Utah. You further agree that jurisdiction and venue for the purposes of resolving any dispute relating to any action or communications initiated at this website shall be in Washington County, Utah.

Finally, you are notified that if you post a request for an answer to a personalized question, the attorney providing the answer will not be able to view it until after reviewing the information you post regarding yourself and any present or potential opponent you may have, and the attorney must then find that there is no conflict of interest between you and any present or past client of that attorney. If a conflict of interest is found, you will be notified via e-mail to the e-mail address which you provide, with a copy of the question included in the e-mail, and all records of your question will be encrypted and retained in a separate data file which the attorney will not access absent a valid court order requiring release of the question. You are further advised that all records of your question and communications with you will be destroyed as a routine matter of course according to an established records retention policy not sooner than four years after their creation.

All communications on this website are considered privileged and confidential under all applicable laws, court rules, and court decisions. Nevertheless, the attorney providing any answer, and Blanchard Legal Solutions, PC, disclaims any and all responsibility and liability for breach of confidentiality which results from illicit third-party interception of those communications, or for any release of confidential communications which you may cause or allow to happen. For more information, please refer to the Privacy Policy, in the text box below.
